Pedestrian alleges motorist hit him in Alton

EDWARDSVILLE — A pedestrian is suing a motorist for allegedly hitting him when she veered off the paved roadway.

Braden Phillips filed a complaint on June 29 in Madison County Circuit Court against Mariah Wheeler, alleging she failed to use the public roadways to operate her motor vehicle with reasonable care and caution.

According to the complaint, the plaintiff alleges that on March 1 he was a pedestrian walking east on the shoulder of E. 20th in Alton when he was struck by the defendant's vehicle. 

As a result, Phillips claims he suffered severe physical injuries, preventing him from attending to his usual duties and causing him to incur medical expenses. 

The plaintiff alleges Wheeler failed to keep a proper lookout for pedestrians near the roadway, failed to operate her vehicle solely on the paved area of the roadway and drove her vehicle while inattentive or distracted.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, plus costs of suit and any other relief the court deems just and proper.
