Driver alleges injuries from 2015 rear-end crash on US 40

EDWARDSVILLE — A driver is suing another motorist, alleging she was injured due to negligence in a 2015 crash in Madison County.

Carita Tarmoh filed a complaint on May 30 in the Madison County Circuit Court against Derek Brenker alleging that the defendant failed in his duty to operate and maintain his vehicle in a reasonably safe manner.

According to the complaint, the plaintiff alleges that on May 28, 2015, her vehicle had come to a complete stop on U.S. 40 when she was struck by the defendant's vehicle, causing damages to the rear-end of her vehicle. As a result, Tarmoh suffered physical injuries, loss of income due to disability and medical expenses. 

The plaintiff holds Brenker responsible because he allegedly failed to operate his vehicle at a reasonable rate of speed and failed to keep a proper lookout.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, plus costs of suit and such additional amounts as the jury and the court shall deem proper. She is represented by John Eliasik of The Law Offices of John S. Eliasik in Chicago.
