Belleville church alleges breach of warranty after sewer system failed

BELLEVILLE — A Belleville church claims its sewer system failed shortly after installation.

First United Presbyterian Church of Belleville filed a complaint on Feb. 24 in St. Clair County Circuit Court against Keel Engineering Inc. and H & M Backhoe Services Inc.,alleging they failed to provide the plaintiff the services needed as agreed by contract.

According to the complaint, the church contracted both defendants to design and build a system to move wastewater sewage from the church building to the city sewer system. After two years, the plaintiff noticed that the system failed, causing pump failures and failure of the whole system.

As a result, the system became inoperable and cost the plaintiff considerable expense to repair. 

The plaintiff alleges the defendants failed to comply with all the requirements and terms of the agreement, failed to properly design and install the system and failed to repair, replace or compensate plaintiff for the damages.

The plaintiff requests a trial by jury and seeks judgment for its losses in sum exceeding $50,000 and other such relief the court grants.

The plaintiff is represented by Kenneth L. Halvachs and Ronald J. Abernathy Jr. of Halvachs & Abernathy LLC in Belleville.
