BELLEVILLE — A former U.S. Army soldier, logging laborer and roofer is suing 3M Company, A.W. Chesterton Company, Grinnell LLC, et al, asbestos containing products manufacturers, alleging insufficient measures were taken to prevent injuries.

Francis L. Kyser filed a complaint on Feb. 7 in the St. Clair County Circuit Court against the defendants, alleging that they breached their duty to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiff alleges that, during the course of his employment and during non-occupational work projects from 1966 to 1999, he was exposed to and inhaled asbestos fibers emanating from certain products he was working with. On Jan 15, 2016, he claims, the plaintiff first became aware that he had developed lung cancer. The plaintiff holds 3M Company, A.W. Chesterton Company, Grinnell LLC, et al responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available, and failed to provide adequate warnings and instructions on how to safely use their products containing asbestos fibers.

The plaintiff requests a trial by jury and seeks judgment against the defendants in a sum in excess of $50,000 which will fairly compensate plaintiff's injury and for such other relief as the court deems appropriate. He is represented by Ethan A. Flint, Laci M. Whitley and Jim M. Price of Flint Law Firm LLC in Glen Carbon.
