Highland motorist blamed for bicyclist's injuries

EDWARDSVILLE — A suit filed on a minor's behalf accuses a motorist of taking insufficient measures to prevent injuries.

Ethan Tucker, a minor, through his next friend Brandy Tucker, filed a complaint on Dec. 13 in Madison County Circuit Court against fellow Highland resident Mary Sherman, alleging that the motorist failed to operate her vehicle in a careful and prudent manner.

According to the complaint, the plaintiff alleges that on June 25, 2015, Ethan Tucker was riding his bicycle in the parking lane of a street when the defendant negligently crashed her car into him, thereby causing him to fall from his bicycle and sustain injuries that required emergency medical treatment. The plaintiff holds Sherman responsible because the defendant allegedly failed to maintain proper control of her vehicle, failed to keep proper lookout and failed to yield right of way.

The plaintiff requests a trial by jury and seeks damages in a reasonable amount in excess of $25,000, plus interest, costs for this suit and all other relief that the court deems just and proper. He is represented by Brent A. Sumner of The Sumner Law Group in St. Louis.
