Pedestrian seeks damages from Collinsville motorist, insurer after collision

EDWARDSVILLE — A pedestrian is suing a motorist and her insurer following a Collinsville collision.

Steven E. Anton filed a complaint on Nov. 28 in Madison County Circuit Court against Kaley M. Humphrey and State Farm Mutual Automobile Insurance Co., alleging Humphrey breached her duty to exercise due care and caution in the operation of her vehicle.

According to the complaint, the plaintiff alleges that on Jan. 8, he was lawfully walking north on Morrison Avenue in Collinsville when the defendant struck him as he crossed Hill Street. He claims he was thrown into the air and landed on top of the passenger side of the defendant's vehicle.

As a result, he claims he suffered serious personal injuries, pain and anguish and spent large sum of money to address his injuries.

The plaintiff alleges Humphrey operated her vehicle at a speed greater than reasonable, failed to maintain proper control of her vehicle and failed to keep sufficient lookout.

The plaintiff requests a trial by jury and seeks compensation in excess of $50,000, attorney's fees and costs.
