Six-year-old accident suit settles before trial begins

A six-year-old car accident suit settled for an unspecified amount on Nov. 16, nearly two weeks before it was set to go to trial in Madison County Circuit Judge William Mudge’s courtroom.

The case was set for trial on Nov. 28.

Mark Leonard filed the lawsuit against Dawn Robles in 2010 through attorneys Lynn Fischer and Christine Fuchs of The Fischer Law Firm LLC in Clayton, Mo. He claims he was injured in a Dec. 4, 2008, collision.

According to the complaint, Leonard claims he was operating his vehicle on IL Route 40 in a westerly direction near the intersection with Spring Valley Road. At the same time, Robles was operating her vehicle on Spring Valley Road in a northerly direction at its intersection with IL Route 40.

Leonard claims Robles entered the intersection, causing the front of Leonard’s vehicle to collide with the side of Robles’ vehicle.

As a result, Leonard claims he sustained serious and permanent personal injuries to his head, ears, left eye, right knee, chest, face, left wrist, trunk, spinal column, vertebrae, intervertebral discs and limbs.

The plaintiff claims Robles negligently and carelessly drove and operated her vehicle at an excessive rate of speed, failed to exercise the ordinary degree of care, failed to keep a lookout, failed to stop or reduce speed, failed to swerve to avoid a collision and failed to yield to a stop sign.

Robles denies the allegations against her. She argues Leonard failed to reduce speed in order to avoid the accident, failed to keep a careful lookout, and contributed to his injuries by being contributory negligent.

She was represented in the case by Deborah Bell Yates of St. Louis.
