Man alleges dog attacked him, caused injuries

BELLEVILLE — A man is suing a dog owner after he was allegedly attacked by loose dogs.

Joseph Cotton filed a complaint on Oct. 7 in St. Clair County Circuit Court against Daren Byest, alleging that the pet owner violated the Illinois Animal Control Act.

According to the complaint, the plaintiff alleges that on June 9, he was peaceably conducting himself at the Belleville home of his wife and daughter when the defendant's two pit bulls, without any provocation, entered the premises and viciously attacked him, fracturing his left wrist.

He claims he has suffered pain and suffering, disfigurement and medical expenses.

The plaintiff alleges Byest failed to cage, leash and/or restrain his pit bull dogs and failed to become aware of his dogs' unmanageable behavior.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount exceeding $50,000, plus interest, costs and other remedies as the court will allow. He is represented by Rodney D. Caffey and Ralph J. Mendelsohn of The Cafey Law Firm LLC in Godfrey.
