BELLEVILLE — A coal mine employee is suing Lively Grove Mine, alleging he was injured when he allegedly inhaled harmful gases while at work.

Cory Spytek and his wife filed a lawsuit Aug. 1 in St. Clair County Circuit Court against Praire State Generating Company, Lively Grove Mine and Justin Reese, alleging negligence in failing to provide a safe place to work.

According to the complaint, on July 30, 2014, while working for Lively Grove Mine near Marissa, Spytek claims he inhaled carbon dioxide and other harmful gases, causing him to sustain injuries, pain and suffering, loss of normal life and medical expenses. The suit says his wife suffered loss of consortium.

The plaintiffs allege the defendants failed to properly examine the mine as required by federal regulations and failed to exercise reasonable care for the safety of their employees.

The Spyteks seek a trial by jury and judgment of more the $100,000 against each defendant. They are represented by attorney William J. Meacham of Edwardsville.
