Bank of Edwardsville sues customers over alleged default

EDWARDSVILLE — A banking corporation is suing former customers, alleging they owe more than for $85,000 after defaulting.

The Bank of Edwardsville filed a lawsuit July 27 in Madison County Circuit Court against Optimal Health Medicine LLC, OHM Equipment LP, Jon A Wagon and Jennifer E. Wagon, alleging failure to comply with their promissory note and change in terms agreement.

According to the complaint, The Bank of Edwardsville has suffered monetary damages for not receiving payment of $79,412.48, plus interest of $1,919,98 and attorney fees of $4,500 from the defendants. 

The plaintiff alleges the defendants failed to comply with their promise to make regular monthly payments and, despite repeated demands, they have defaulted in making payments on principal or interest.

The Bank of Edwardsville seeks a trial by jury, judgment of $85,832.46, plus attorney fees, interest and costs of suit. It is represented by attorney George E. Marron III of Highland.
