BELLEVILLE — A Missouri trucking company is suing an ammunition wholesaler, alleging the defendant owes more than $100,000 for improperly loading one of the plaintiff's trucks. 

Afton Trucking Company Inc. filed a complaint on June 23, in the St. Clair County Circuit Court against Buffalo Corp., alleging breached of the contract of carriage.

According to the complaint, on April 14, Afton was transporting Buffalo's ammunition boxes when its tractor, container and chassis transporting the goods rolled over on the roadway at the junction between North Main Street and Wil Road in Dupo. 

The suit says the accident caused Afton property damage of more than $93,000, loss of annualized gross earning of $193,000, workers compensation of $25,000 and clean-up costs of $6,400. The plaintiff alleges Buffalo improperly loaded and stowed the ammunition boxes on pallets that were improperly secured in the container, and improperly certified the weight of the container.

Afton Trucking seeks a trial by jury, judgment of more than $93,000 for the Mack tractor, plus the loss of revenue, $25,000 for workers compensation and $6,400 for remediation of the incident, plus such other relief as the court deems just.
