Defendant in bar fight suits settles two claims for $3K

Law money 05

A defendant accused of punching two men in the face without provocation nearly three years ago at a Godfrey tavern is settling the claims against him.

Attorneys representing Christopher Green have agreed to pay Don Seals $2,500 and Steve Kelley $500 over an altercation that took place at Beer Barrel Pub on June 16, 2013.

Seals and Kelley filed individual suits in Madison County in 2014 against the bar and others involved in the incident, including Alan J. Cox, Jr. and Cody J. Elfgken.

The plaintiffs, represented by Michael R. Wesley of Wood River, claim that Green struck them in the face “repeatedly” with his fists “and other objects” which caused them to suffer fractures below their eyes and other parts of their bodies.

According to settlement documents, Green agreed to settle both cases after “protracted negotiations.”

“Defendant Christopher Green has contested liability and denies that he committed any tortious conduct as alleged…,” wrote his attorneys Kristine Mack and Jason Gourley of Donovan Rose Nester in Belleville on April 1.

Claims against Beer Barrel Pub, represented by Stephen J. Moore of Galloway, Johnson, Tompkins, Burr and Smith in St. Louis, remain.

Circuit Judge Dennis Ruth presides.

On April 29, Ruth approved the settlement, dismissing Green from the suits.

Seals: Madison County Circuit Court case number 14-L-146.

Kelley: Madison County Circuit Court case number 14-L-147.
