Wood River tenant sues after falling down basement stairs

EDWARDSVILLE – A tenant is suing her landlord over injuries she allegedly suffered during a fall down basement stairs.

Shannon Kinsey filed the suit March 28 in Madison County Circuit Court against Jerry Abert, who owns a rental property in Wood River.

On July 1, 2015, the plaintiff claims she fell down the basement stairs as a result of faulty design and maintenance, according to the complaint. Further, the stairs were in violation of the International Residential Code adopted by the city of Wood River, Kinsey claims.

Kinsey alleges the defendant negligently failed to adequately manage the premises, failed to inspect the premises, permitted occupancy of the premises when it wasn't reasonably safe to do so, and allowed the stairs to be built or maintained in violation of the city's code.

Kinsey alleges she sustained injuries to her head, neck and back; pain and suffering; disability that will cause her loss of a normal life; lost wages; medical expenses; and greater susceptibility to injury in the future.

The plaintiff seeks an amount greater than $50,000 and other relief the court deems proper. She is represented by Jarrod P. Beasley of Kuehn, Beasley & Young PC in Belleville.
