Man sues own insurance company in underinsured motorist claim

BELLEVILLE – A motorist is suing his insurance company for its alleged refusal to pay an uninsured motorist claim.

Jonathan Dedman filed the suit March 14 in St. Clair County Circuit Court against USAA Casualty Insurance Company.

On March 26, 2014, the plaintiff was driving his vehicle on Scott Air Force Base in St. Clair County when he was involved in a collision with a car driven by Andrew Johnson.

At the time of the collision, Johnson's auto insurance policy provided for bodily injury limits but the plaintiff's injuries allegedly exceed those limits.

The plaintiff's vehicle was insured under a policy issued by the defendant and it included underinsured motorist coverage, according to the complaint.

The plaintiff seeks judgment in the amount that his damages exceed the policy limits available to him under Johnson's policy up to the underinsured motorist limits under his policy with the defendant.

Also, the policy with the defendant, the suit alleges, contains an arbitration provision relative to the underinsured motorist claim so the plaintiff demanded arbitration.

The plaintiff asks the court to order the defendant to produce certified copies of the policies providing him coverage, to proceed to arbitration of the underinsured motorist claim, that any arbitrated award be entered in his favor, that he be awarded court costs, and that he receive other relief as the court deems just and fair.
