EDWARDSVILLE – A visitor to a property in Cottage Hills is suing the property owner, alleging negligence for injuries the plaintiff says he sustained after a slip and fall on black ice.

James Thomason filed the lawsuit March 1 in Madison County Circuit Court against Don Holmes, who owned, operated and maintained the property, alleging negligence and premises liability.

According to the complaint, on March 4, 2014, Thomason was at 91 N. Stanley Road to visit an acquaintance. The suit says he slipped on the black ice, hit the ground and sustained severe and permanent injuries.

  

Despite the duty owed the plaintiff and others to keep the premises safe, according to the suit, the defendant failed to properly maintain the parking lot, failed to provide a slip-resistant surface, failed to warn of the dangerous condition of the parking lot and failed to provide ice removal services so as to avoid an unnatural accumulation of ice.

 As a result of the negligence, the lawsuit states, the plaintiff suffered severe and permanent physical injuries, past and future pain and suffering, loss of enjoyment of life and medical expenses. He also expects to have difficulty performing his usual daily activities, and has endured disability and the loss of a normal life, the suit says.

Thomason seeks compensatory damages of more than $50,000 for each count, court costs and any other relief the court deems appropriate. He is represented by attorney Joseph N. Reames of The Law Office of Joseph N. Reames LLC in Wood River.
