Man sues landlords over negligence claims after fall

EDWARDSVILLE – A tenant of a Collinsville property is suing over injuries he alleges he suffered when he slipped and fell on damp basement stairs.

Kevin W. Sumner filed the suit Feb. 8 in Madison County Circuit Court against Scott Kilbury and Tina Kilbury, citing negligence.

According to the complaint, the plaintiff rented property owned by the defendants at 1324 Leland St., Collinsville. On Feb. 2, 2015, the plaintiff was walking up the basement stairs when he fell due to moisture that had allegedly accumulated on the stairs as a result of the sump pump not working properly and injured his right ankle and leg, the suit states.

The suit states that the serious injuries to the plaintiff's right ankle and leg have resulted in surgery as well as pain to the plaintiff. He allegedly will continue to undergo medical care and numerous diagnostic procedures for which he has accumulated bills.

Sumner holds the defendants responsible for their alleged failure to maintain the property or the equipment that maintains the property to prevent injury to tenants, guests or others, and failing to repair known defects in a timely manner.

The plaintiff seeks judgment against the defendants in an amount greater than $50,000 plus court costs. He is represented by Keith Short of the Law Offices of Keith Short PC in Collinsville.
