Kentucky firm alleges Interstate Farm failed to pay for purchases

BENTON – A Kentucky corporation is suing a Kansas company, alleging the defendant has not made any payments for goods and services.

Hutson Inc. of Murray, Ky., filed a lawsuit Feb. 9 U.S. District Court for the Southern District of Illinois against Interstate Farm Products LLC of Kansas.

According to the complaint, on March 10, 2015, Joe F. Cole, acting on behalf of Farm Products, executed an account application to purchase goods and services on credit from Hutson. Five days later, the suit says, the plaintiff sold equipment to the defendant, which sometimes did business under the name “Southern Illinois Implement.”

 

As of Aug. 15, the defendant owed the plaintiff $114,805, the complaint states, and Hutson's counsel sent a letter to Cole demanding payment by Aug. 21. On Aug. 17, the business manager for the defendant sent plaintiff's counsel an e-mail stating the defendant wanted to set up a payment arrangement, the suit says,  yet no payments have been received.

Hutson Inc. seeks $114,805 plus pre- and post-judgment interest of 24 percent annually until judgment is paid in full, or $75.50 per day. The plaintiff also seeks costs of collection, court costs, attorney fees and any other relief the court deems proper. It is represented by attorney Bobby R.
