Customer sues Edwardsville Captain D's over trip and fall

EDWARDSVILLE – A Wood River woman is suing an Edwardsville restaurant and its owners, alleging negligence over injuries she says she received after tripping in the restaurant parking lot.

Barbara Hillman filed the lawsuit Feb. 4 in Madison County Circuit Court against Captain D's LLC and SHN Properties LLC, owners of the Captain D's property.

According to the complaint, on Dec. 7, 2014, Hillman arrived at Captain's D in Edwardsville for dinner. While the plaintiff was crossing the parking lot to the entrance of Captain D's, the suit says, she tripped and fell on the exposed brick of the sidewalk where it meets the asphalt parking lot.

The lawsuit states the design, construction and maintenance of the sidewalk and parking lot created a hazardous condition that caused Hillman to trip and fall. 

Specifically, the complaint says, the defendants were negligent in failing to maintain and then repair the sidewalk, failing to keep a level and even surface between the parking lot and the sidewalk, thereby creating a tripping hazard, failing to indicate the height differential between the two, and failing to post signs warning of the height differential.

The plaintiff alleges the injuries she sustained include a severe laceration to her forehead and scalp and a fractured right wrist. She said those injuries have impaired her health, strength, and ability to work and engage in other activities.

Hillman seeks at least $50,000 from each defendant, plus court costs and other relief the court deems proper. She is represented by attorney Christopher B. Hunter of Hunter & Johnson PC in Godfrey.
