Breach of contract alleged in St. Clair County restaurant transaction

Two men are suing a Sangamon County man, alleging unpaid dividends of an investment in a restaurant.

Dave Butz of St. Clair County and Eugene Schill of Missouri filed a lawsuit on Nov. 16 in St. Clair County Circuit Court against Christopher Stone of Sangamon County.

According to the complaint, on Dec. 12, 2012, Butz and Schill each purchased from Stone a 1.875 percent interest in Lucy's Place restaurant in St. Clair County. In exchange for those shares, the plaintiffs say they each paid the defendant $65,000. 

However, despite repeated requests, the defendant allegedly refused to transfer the stock to the plaintiffs. In addition, the suit says, the shares have yielded dividends but Schill has not paid the plaintiffs for those dividends. The plaintiffs allege the defendant is in breach of contract.

Butz and Schill seek either that the contract be executed properly or that the defendant pay at least $200,000 for damages they sustained as a result of his breach of contract, plus court costs and attorney fees. They are represented by attorney Alvin C. Paulson of Belleville.
