Car passenger alleges driver negligent in auto accident

EDWARDSVILLE – A Madison County woman is suing a motorist, alleging negligence for the injuries she suffered in an accident when she was a passenger.

Amanda Duncan filed the lawsuit Oct. 9 in Madison County Circuit Court against James Kudelka of Granite City. 

According to the complaint, on Oct. 12, 2013, Duncan was a passenger in Kudelka's vehicle traveling eastbound on state Route 162. At the same time, another vehicle was being driven in front of the defendant's vehicle when it stopped short, the suit says.

Kudelka did not stop and crashed into the rear of that vehicle, the lawsuit states, causing Duncan to suffer injuries to her head, neck, back and spine. The plaintiff says she has sought medical treatment and has charges of more than $10,000. She expects more medical bills in the future, as well as loss of income, disability and loss of a normal life, the suit says.  

Duncan seeks damages of more than $50,000, court costs, attorney fees and a trial by jury. She is represented by attorney Zane Cagle of The Cagle Law Firm in St. Louis.
