St. Clair Square Mall sued over leaky toilet

A shopper is suing St. Clair Square Mall for injuries she allegedly sustained after slipping on a pool of water in the bathroom.

Beverly Postar filed a lawsuit in St. Clair County Circuit Court on Oct. 7 against St. Clair Square Limited Partnership, d/b/a St. Clair Square Mall, CBL & Associates Management, Inc. d/b/a St. Clair Square Mall, ERMC II L.P., and Vic White for negligence.

According to the complaint, on or about Dec. 9, 2008, Postar entered the St. Clair Square Mall and used one of its restroom stalls. She claims she allegedly slipped and fell on a pool of water on the floor in the stall, causing injuries to her pelvis, right foot, right hand and teeth.

She alleges severe, extensive and permanent injuries, disability, and disfigurement.

The plaintiff argues that the defendants failed to properly secure the toilet to the floor, allowed water to leak out, failed to warn its customers about the defect, permitted its customers to use the defective toilet and failed to inspect the toilet.

As a result of the defendant's neglect, the plaintiff claims she suffered physical and mental pain.

Postar is suing for excess of $50, 000.00 and costs of the suit. She is represented by Matthew J. Marlen of Matthew J. Marlen, P.C. in Belleville.
