O'Fallon man sues alleged intoxicated driver following hit-and-run collision

An O'Fallon man is suing a Waterloo resident for allegedly driving while intoxicated and causing a hit-and-run vehicle accident. 

Steven Gilroy filed a lawsuit on Sept. 25 in St. Clair County Circuit Court against Thomas D. Burke, claiming his recklessness and excessive speed caused an accident resulting in injuries.

According to the complaint, Gilroy claims that on Oct. 3, 2013, he was driving on Interstate 255 near milepost 9.5 in the middle lane when the vehicle operated by Burke struck him from behind. Gilroy alleges his vehicle was pushed off of the roadway and Burke then fled the scene of the accident.

Gilroy alleges Burke was driving while intoxicated and driving at an excessive speed, and that his negligence is what caused the accident, the suit states.

Gilroy claims he sustained severe injuries requiring medical attention and has suffered loss of life, loss of wages and incurred several thousands of dollars worth of medical bills.

Gilroy is seeking an amount in excess of $50,000 and for such further relief as the court sees fit. Gilroy is represented by Michael L. McGlynn of McGlynn & McGlynn in Belleville.
