Pedestrian sues driver for allegedly hitting her in parking lot

A St. Clair County couple filed a lawsuit against a motorist for allegedly hitting and injuring the woman as she walked behind his truck.

Delores Marie Menard and Allen W. Menard filed a lawsuit against Carl E. Brumit Jr. and Brumit Services Inc. d/b/a Brumit Concrete and Home Services on June 18 in St. Clair County Circuit Court, alleging vehicular negligence in a parking lot accident in September 2013.

According to the complaint, the woman was walking across a service station parking lot located at 1553 North Main Street in Columbia on Sept. 6, 2013, behind a stationary Ford F-350 flatbed truck belonging to and occupied by Brumit.

The suit states that as Delores walked behind the vehicle between 12:35 and 12:45 p.m., the defendant "suddenly and unexpectedly" backed out of the parking space his vehicle was occupying—colliding "forcefully" with the plaintiff, knocking her to the ground, and causing injuries.

The plaintiffs accuse the defendant of failure to keep a proper lookout to the rear while driving the truck in reverse; control the vehicle; observe the pedestrian, and stop in time to avoid impact.

The suit states that Delores Menard sustained injuries to her back, spine, and soft tissues. She alleges severe and disabling injury, pain, anguish, suffering and medical expenses. Her husband alleges loss of consortium, companionship, affection, and household services, for which he claims he must now spend large amounts of money to have completed for him.

The plaintiffs seek judgment in their favor in excess of $50,000 plus attorneys’ fees and costs and are represented by Tom Adams of Adams and Huetsch in Columbia, IL.
