East St. Louis motion to dismiss case against police officer denied

St. Clair County Circuit Judge Andrew Gleeson has denied the City of East St. Louis’ motion to dismiss a man’s lawsuit alleging an officer hit him with a patrol car while he was walking across the street.

According to the complaint filed April 22, Raymond Wilbourn claims he was walking across North 25th Street in East St. Louis in April 2012 when officer Lester Anderson allegedly struck him with his patrol car.

Wilbourn blames Anderson for speeding when the collision occurred and accuses both the officer and the department of negligence.

Anderson is being sued individually and in his official capacity as a police officer for the East St. Louis Police Department.

Wilbourn seeks a judgment of more than $50,000.

Gleeson denied the city’s motion on Oct. 15.
