Route 4 accident blamed on failure to obey stop sign

An Effingham County woman claims she sustained serious injuries in a collision after a driver failed to yield the right-of-way.

Donna R. Denton filed a lawsuit April 29 in Madison County Circuit Court against Allison E. Lutz.

In her complaint, Denton alleges she rode in a 2009 Chevrolet Tahoe that was traveling north on Illinois Route 4 at about 3 p.m. near its intersection with Rose Road in St. Jacob. At the same time, Lutz drove her 1997 Honda Civic east on Rose Road when she approached a stop sign, according to the complaint. However, Lutz failed to obey the traffic signal and struck Denton’s vehicle, the suit states.

Because of the collision, Denton experienced pain and suffering, incurred medical costs, experienced permanent disfigurement and disability and lost wages and her enjoyment of life, the complaint says.

Denton blames Lutz for causing the collision, saying she negligently failed to obey a stop sign, failed to yield to Denton’s vehicle, failed to keep her vehicle under control, failed to decrease her speed to avoid a collision and failed to exercise reasonable care.

In her complaint, Denton is seeking a judgment of more than $50,000, plus costs.
