Accident victims sue driver working for Madison County Public Administrator

Two people have filed suit against the driver who they claim crossed the center lane of traffic, causing them to sustain head, neck, back, chest and shoulder injuries.

Michael and Michelle Timmons claim Michael Timmons was driving north on Illinois State Route 111 near its intersection with New Page Road in Chouteau on Jan. 20 when Neil Hopkins, who was driving south on the same road for defendant Madison County Public Administrator Rene Butler, crossed the center lane and struck the front of the Timmons’ vehicle.

In addition to their injuries, the Timmons were made sick, sore, lame, disordered and disabled; incurred medical costs; and suffered disability, according to the complaint filed March 22 in Madison County Circuit Court. They also experienced pain and suffering and lost wages, the suit states.

Hopkins negligently failed to keep a proper lookout, failed to properly apply his brakes, drove too fast, failed to decrease his speed because of weather conditions, failed to drive entirely in the right-hand lane, drove on the wrong side of the road and failed to decrease his speed when approaching the crest of a hill.

In their complaint, the Timmonses are seeking a judgment of more than $100,000, plus costs.

Thomas C. Rich, Kristina D. Cooksey and Michelle M. Rich of Fairview Heights will be representing them.

Madison County Circuit Court case number: 13-L-476.
