Alton and Southern worker claims defective pin lifter caused injuries

A man claims he suffered painful, permanent and disabling injuries to his left hip, left shoulder, neck, back and spine after using defective equipment while working.

Kenneth E. Wilson filed a lawsuit March 8 in St. Clair County Circuit Court against The Alton and Southern Railway Company.

In his complaint, Wilson alleges he was required to operate a defective pin lifter while working for The Alton and Southern Railway Company on Jan. 28.

Because of his use of the defective machinery, Wilson experienced pain and suffering; endured psychological and emotional injuries; and suffered mental anguish and anxiety, according to the complaint. He also incurred medical costs and lost wages and his earning capacity, the suit states.

Wilson blames the railway for causing his injuries, saying it negligently failed to provide him with a safe place to work, failed to provide him with safe work conditions, failed to provide him with safe equipment, failed to maintain its equipment and violated the Safety Appliance Act.

In his complaint, Wilson seeks a judgment of more than $50,000, plus costs.

Nelson G. Wolff and Jacob C. Murov of Schlichter, Bogard and Denton in Belleville will be representing him.
