Man working on second floor patio sues after boards give way

A man claims he suffered neck, shoulder, low back and upper body injuries after he fell through rotten wooden boards.

Nelson Rodgers filed a lawsuit Feb. 26 in St. Clair County Circuit Court against Willy Nichelson and N&F Corporation.

In his complaint, Rodgers alleges he was working on the second floor patio at his home at 9001 Lebanon  Road in Belleville on Oct. 31 at about 1:15 p.m. when he fell through the floorboards.

Because of the incident, in addition to his injuries, Rodgers became sick, sore, lame, disordered and disabled; experienced pain and suffering; and incurred medical costs, according to the complaint.

He blames Nichelson and N&F Corporation, who owned the building, for causing his injuries, saying he negligently failed to inspect the patio, failed to replace rotten floor boards and failed to warn of a dangerous condition.

In his complaint, Rodgers seeks a judgment of more than $100,000, plus costs.
