Shiloh accident at Sierra leads to injury suit

A woman claims she sustained head, neck, chest, ribs, back, right shoulder, left shoulder, right side, left side and right leg injuries after a driver failed to yield the right-of-way when making a left-hand turn.

Nicole Jung filed a lawsuit Feb. 19 in St. Clair County Circuit Court against Cheyenne M. Schmitz.

In her complaint, Jung alleges she drove a 2000 Chevrolet Cavalier west on Lebanon Avenue near its intersection with Sierra Drive in Shiloh on Feb. 27, 2011, when Schmitz, who drove a 2000 Mitsubishi
Eclipse east on the same road, attempted to make a left-hand turn and struck her vehicle.

In addition to her injuries, Jung incurred medical costs, experienced great pain and mental anguish, suffered disability and lost her normal life, the suit states.

Jung blames Schmitz for causing the collision, saying she negligently failed to keep her vehicle under proper control, failed to keep a proper lookout, drove in an unsafe manner, drove too fast, failed to take evasive action to avoid a collision and attempted to make a left-hand turn when it was not safe to do so, among other negligent acts.

In her complaint, Schmitz seeks a judgment of more than $50,000, plus costs.

Daniel C. Katzman will be representing her.

St. Clair County Circuit Court case number: 13-L-89.
