Loans to TFV Trucking, Topflight Logistics not paid, suit claims

Two people claim a few Jefferson County residents have failed to follow through on their promise to repay more than $200,000 worth of debt.

Robert and Mary Carter filed a lawsuit March 1 in Madison County Circuit Court against Randall Hannis and Jody D. Markel.

In their complaint, the Carters allege they lent TFV Trucking $100,473.04 on Oct. 7, 2008. They also let Topflight Logistics borrow $151,088.76, according to the complaint.

The defendants acted as guarantors on both notes, promising to repay them, according to the complaint.

TFV Trucking failed to make its required monthly payments after it dissolved on Aug. 14, 2009, the suit states. Likewise, Topflight Logistics dissolved on Dec. 12, 2008, and stopped making payments on its note.

In turn, the defendants are responsible for repaying the money, the complaint says. However, despite several notices, they have failed to do so, the Carters claim.

“As of Jan. 31, 2013, there was due and owing to plaintiff the principal amount of $100,473.04, plus accrued interest in the amount of $66,604.45 for a total amount due as of Jan. 31, 2013, of $167,074.49,” the suit states of the TFV loan.

“As of Jan. 31, 2013, there was due and owing to plaintiff the principal amount of $151,088.76, plus accrued interest in the amount of $91,895.36 for a total amount due as of Jan. 31, 2013, of $242,984.12,” the complaint says of the Topflight loan.

In addition to the money they claim they are owed, the Carters seek costs, attorney’s fees and other relief the court deems just.
