K-Mart Corp. is expected to respond to a woman’s lawsuit over injuries she sustained when a 50-pound turkey fryer fell on her.
K-Mart received a summons from the Cook County Sheriff’s Department at its Chicago office in December. The summons was filed March 4 in Madison County Circuit Court.
Elisha N. Naumann filed suit Nov. 15 against K Mart Corp., claiming a turkey fryer fell from a shelf and hit her in the head Nov. 21 at the Alton K-Mart.
The summons was expected in 30 days.
She blames the company for failing to implement adequate policies governing the safe placement, stacking, storage, shelving and retrieval of merchandise.
Naumann seeks damages for injuries that include “severe bruising, contusion, wrenching, straining, spraining, tearing, twisting and pulling of the bones, nerves, tissues, tendons, ligaments and muscles of the head, neck, shoulder, back, and spine, and all musculoskeletal areas adjacent thereto,” the complaint states.
She is represented by Bradley Lakin of SL Chapman in St. Louis.
