Woman claims GM has failed to fix her defective Cadillac SRX



A St. Clair County woman claims she purchased a defective Cadillac, but is unable to return or repair it because General Motors allegedly refuses to assist her.

Ashley Hilliard filed a lawsuit Nov. 28 in St. Clair County Circuit Court against General Motors.

In her complaint, Hilliard claims she began experiencing numerous problems with the 2011 Cadillac SRX she purchased on May 31, 2011, for $32,455.64. The vehicle’s alleged defects included damaged body and trim, noisy steering and suspension, a defective heating system that failed to heat the driver’s side seat and a defective fuel tank, according to the complaint.

Hilliard brought the Cadillac to General Motors for repair work, but the company’s workers were unable to repair the vehicle despite multiple attempts, the suit states.

When she purchased the automobile, Hilliard was also supplied with a four-year or 50,000-mile warranty. After the vehicle could not be repaired, she revoked her acceptance of it, the complaint says. However, General Motors refused to honor it, and Hilliard alleges she is stuck with the vehicle.

Because of the numerous problems she has encountered with the Cadillac, Hilliard claims she lost its use, experienced a diminished value, incurred repair costs and lost wages.

She alleges breach of written warranty and breach of implied warranty against General Motors.

In her two-count complaint, Hilliard seeks a return of all the money she paid, plus incidental and consequential damages, attorneys’ fees, court costs and other relief the court deems just.
