A woman has filed suit against the driver who she claims failed to yield at a stop sign and struck her vehicle in Fairview Heights.
Ashley Hubbard claims she was driving east on Kassing Avenue on Aug. 28, 2011, at about 4:05 p.m. when defendant Donald W. Wilson, who was driving north on Pontiac Drive, suddenly failed to stop at a sign controlling his road. Because there were no stop signs governing Kassing Avenue, Hubbard claims she had not stopped before entering the intersection.
“Plaintiff Ashley Hubbard did not have the chance to avoid the collision due to its sudden and unforeseeable nature,” the suit states.
Because of the collision, Hubbard became sick, sore, lame and disordered; suffered serious and painful injuries to her neck, back and spine; and endured physical pain and mental anguish, according to the complaint filed Oct. 24 in St. Clair County Circuit Court. She also incurred medical costs and lost $504.50 in lost wages, the complaint says.
Hubbard blames Wilson for causing the collision, saying he negligently failed to keep a careful lookout, failed to exercise a high degree of care when he entered the intersection, violated a traffic control device, failed to yield the right-of-way and failed to warn of his impending approach.
In her complaint, Hubbard is seeking a judgment of more than $50,000, plus other relief the court deems just.
