Troy woman sues city over alleged sidewalk defect

A Troy woman accuses the city of negligence after she allegedly tripped and fell on a sidewalk in her subdivision.

Sharon Mays filed the complaint Oct. 16 in Madison County Circuit Court against the City of Troy.

Mays lives in the 1500 block of Fairoaks Drive, part of Troy's Fairoaks Subdivision,
according to the complaint.  While walking in her neighborhood on Aug. 21, Mays says she tripped and fell on a sidewalk and was seriously injured.  She says one part of the concrete was "raised and not in alignment" with other sections of the sidewalk, "creating a condition which was difficult to see." The alleged defect left Mays "exposed to an unreasonable risk of tripping and falling," according to the complaint.

Mays says she broke her right wrist and received other injuries to her head, face and arm in the fall.

Mays contends the City of Troy was negligent for allegedly failing to repair the sidewalk or warn pedestrians of the danger. She says that negligence makes the defendant liable for her medical expenses, lost time at work, pain and suffering.

Mays is asking to be awarded more than $50,000 in damages plus interest and court costs. Attorneys Andrew G. Toennies and Michael C. Seamands, of St. Louis, are representing her.
