Thirty foot fall from Genie Lift leads to suit against painting company

The owners of Millstadt painting company are being sued by a contractor who allegedly fell nearly 30 feet while on a job.

Michael E. Smith filed a lawsuit Oct. 11 in St. Clair County Circuit Court against Al and Margaret Ramsdale, doing business as Custom Decorators and also known as C&D Painting.

According to the complaint, Smith was hired as an independent contractor by the Ramsdales to help paint the roof of their barn on Bohleysville Road in June. Smith says both he and Al were in a Genie Lift that was extended almost 30 feet in the air when it tipped over and fell to the ground. Smith accuses the Ramsdales, and their company, of negligence for allegedly setting up the lift on unstable ground and too far from the building they were painting. Smith says he was seriously injured when he fell from the motorized lift.

Smith asks for more than $100,000 in damages for medical bills, loss of income and court costs.

He is represented by attorney P. Michael Read of Belleville.
