Driver failed to yield right of way in Belleville accident, suit claims

A woman claims she sustained various injuries after a driver struck her vehicle at an intersection.

Andreia M. Johnson filed a lawsuit Sept. 12 in St. Clair County Circuit Court against Alicia M. Simpson and Steven C. Simpson.

In her complaint, Johnson claims she drove a 2001 Ford Taurus east on West C Street near its intersection with North First Street in Belleville on Sept. 17, 2010, at about 8:05 p.m. when Alicia Simpson, who drove a 1998 Ford Taurus, failed to yield the right-of-way at a stop sign and struck Johnson's vehicle.

In addition to her injuries, Johnson suffered physical and mental pain and anguish and incurred medical costs because of the collision, according to the complaint.

She blames Alicia M. Simpson for causing the collision, saying she negligently failed to keep her vehicle under proper control, failed to keep a proper lookout, failed to stop or swerve to avoid a collision and drove without safe brakes.

In addition to Alicia M. Simpson, Johnson names Steven C. Simpson as a defendant. Steven C. Simpson owned the 1998 Ford Taurus Alicia M. Simpson drove at the time of the collision and negligently allowed Alicia M. Simpson to drive the car when he knew she lacked the skills and the experienced required to operate the vehicle and when he knew of the vehicle's unsafe condition, the suit states.

In her complaint, Johnson seeks a judgment of more than $150,000, plus costs.

Thomas B. Cannady of Cannady and Aubuchon in Belleville will be representing her.

St. Clair County Circuit Court case number: 12-L-471.
