Eye surgeons sued on wrongful death claims

A woman has filed suit against various physicians after she claims a recently deceased man was wrongly cleared for surgery.

Susan Levine claims the recently deceased Berthold E. Stover underwent surgery at defendant Ambulatory Surgery Center of Centralia on Oct. 17, 2011. However, defendants JFJ Eyecare doing business as Dr. Terrence G. Klingele, CRNA David E. Lees, Dr. Jeffrey Maher and Eye Surgery Center doing business as Illinois Eye Surgeons failed to properly timely and treat Stover, according to the complaint filed Sept. 10 in St. Clair County Circuit Court.

Before the surgery, defendant Dr. Thomas Gutman of defendant Internal Medicine Specialists faxed a clearance form to the facility that was conducting the surgery. In the form, Gutman negligently approved Stover for the surgery, the suit states.

Due to the surgery, Stover died on Oct. 22, 2011, the complaint says.

Because of Stover's death, Levine suffered grief and sorrow and lost his services, companionship, comfort, instruction, guidance, counsel, training, love and support, the suit states.

In her complaint, Levine is seeking a judgment of more than $350,000, plus costs.

She will be represented by Joseph A. Bartholomew of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville.
