Governor's Parkway accident in Edwardsville leads to suit

A South Roxana man has filed suit against the driver who he claims rear-ended his vehicle.

Carl Claytor claims he was driving a 2009 Hyundai Elantra north on Plum Street near its intersection with Governor's Parkway in Edwardsville on Aug. 12, 2010, when he stopped for a red traffic signal. Suddenly, defendant Thelma Chapman, who drove a 2007 Chrysler Pacifica on the same road behind Claytor, failed to stop in time and struck the back of his vehicle, according to the complaint filed Aug. 8 in Madison County Circuit Court.

Because of the collision, Claytor sustained severe injuries, was hindered from attending to his usual affairs and lost wages, the suit states.

Chapman negligently failed to stop for other vehicles, failed to reduce her speed to avoid a collision, drove too fast, failed to keep a proper lookout and failed to stop or swerve to avoid a collision, the complaint says.

In his complaint, Claytor seeks a judgment of more than $50,000, plus costs.

Mark S. Schuver of Mathis, Marifian and Richter in Belleville will be representing him.

Madison County Circuit Court case number: 12-L-1241.
