Plaintiff responds to Gateway Regional's motion to dismiss

The mother of a minor child who claims her son was raped at a behavioral health treatment facility says the facility used no medical judgment in placing her son in a room with a roommate without supervision.

The mother, identified as C.T., filed a lawsuit May 22 in Madison County Circuit Court against Gateway Regional Medical Center. In her lawsuit, C.T. claims Gateway Regional Medical Center attempted to conceal the event by eradicating evidence, the mother claims.

In response to the defendant's motion to dismiss, the plaintiff claims the Madison County state's attorney and Granite City Police Department are now investigating the defendant.

The plaintiff claims the facility used no medical judgment in assigning their son's room.

The plaintiff also claims the facility allegedly failed to perform a rape test at its facility and allegedly destroyed evidence of the abuse by requiring J.T. to bathe. The defendant violated its own policies and procedures by performing an incompetent investigation, the plaintiff stated.

In her complaint, C.T. alleges her minor son, identified as J.T., was admitted to Gateway May 10. During his stay, J.T. was sexually assaulted and raped multiple times by another patient, according to the complaint.

C.T. seeks a judgment of more than $50,000.

Madison County Chief Judge Ann Callis ordered the parties in the case not to identify the plaintiffs, in response to a motion filed by Marcus asking that his clients be allowed to file under fictitious names.
