Route 159 at Bethel Mine Road accident is subject of suit

A man claims he sustained neck, back and arm injuries after a driver struck the side of his vehicle.

Jason McCoy Sr. filed a lawsuit July 2 in St. Clair County Circuit Court against Heather Harsey.

In his complaint, Jason McCoy Sr. claims he drove north on Illinois Route 159 at its intersection with Bethel Mine Road in Caseyville on April 3 when Harsey, who drove west on Bethel Mine Road, struck the side of his vehicle. At the time of the collision, minors Mason McCoy and Jason McCoy Jr. were riding in a vehicle with their father, according to the complaint.

Due to the accident, both Jason McCoy Jr. and Mason McCoy sustained neck, shoulder and back injuries.

Because of the collision, in addition to their injuries, the plaintiffs became sick, sore, lame, disordered and disabled and incurred medical costs, according to the complaint. They also suffered disability and experienced pain and suffering, the suit states.

Jason McCoy Sr. blames Harsey for causing the collision, saying he negligently failed to keep a proper lookout, drove in such a manner as to strike the side of Jason McCoy Sr.'s vehicle, failed to properly apply her brakes, drove too fast, failed to yield the right-of-way, failed to obey a traffic signal and entered an intersection when facing a red traffic signal.

In his three-count complaint, Jason McCoy Sr. seeks a judgment of more than $150,000, plus costs.
