Driver claims injuries in Route 3 rear-end accident

A couple has filed suit against the driver who they claim rear-ended their vehicle while they slowed to make a right-hand turn.

Candace Kindle claims she was driving a Chevrolet Cobalt south on Illinois Route 3 on Nov. 23, 2010, when she attempted to make a right-hand turn from the turn lane. Suddenly, defendant Dorothy M. Mick, who was driving in the same lane, collided with the back of the Cobalt, according to the complaint filed July 12 in Madison County Circuit Court. At the time of the collision, Candace Kindle's husband, Michael Kindle, was riding in the vehicle with her, the suit states.

Because of the collision, the Kindles sustained injuries, experienced pain and suffering, lost their normal lives, incurred medical costs and lost wages, the complaint says.

They blame Mick for causing the collision, saying she negligently failed to slow down to avoid a collision, failed to pay attention while driving and drove too fast.

In their two-count complaint, the Kindles are seeking a judgment of more than $100,000, plus costs.

They will be represented by Thomas O. Falb of Williamson, Webster, Falb and Glisson in Alton.
