Occupants of parked car sued driver who struck them

Two Madison County residents have filed suit against the driver who they claim struck the parked vehicle in which they were sitting.

Howard Spraggs claims he had parked his vehicle at 3201 Fosterburg Rd. in Alton on June 20, 2010, when defendant Mary L. Pyle struck it. At the time of the collision, Brandy Woodward was sitting in the vehicle with Spraggs, according to the complaint filed June 19 in Madison County Circuit Court.

Because of the collision, Pyle and Woodward sustained severe and permanent injuries, suffered great pain and anguish and incurred medical costs, the suit states. In addition, they lost wages and endured an impaired earning capacity, the complaint says.

Spraggs and Woodward blame Pyle for causing the collision, saying she negligently failed to keep a proper lookout, failed to keep her vehicle under proper control, failed to brake to avoid a collision, failed to stop or swerve to avoid a collision and failed to see the vehicle in which Spraggs and Woodward were sitting.

In their two-count complaint, Spraggs and Woodward are seeking a judgment of more than $50,000, plus costs and other relief the court deems just.

They will be represented by Ronald J. Foster Jr. of Schoen, Walton, Telken and Foster in East St. Louis.
