Evasive move at Raging Rivers causes man's broken leg, suit claims

A Madison County man is suing a Grafton water park and its designers after he allegedly broke his leg trying to avoid another person at the end of a water slide.

David Goodbrake filed a lawsuit June 25 in Madison County Circuit Court against Raging Rivers Waterpark Inc. doing business as Raging Rivers. The H. Adams Development Company is also named as a defendant.

Goodbrake was visiting Raging Rivers in July 2011 when one of the park's employees allegedly told Goodbrake he was free to go down one of the water slides. When he got to the end of the slide, Goodbrake says he noticed someone was still in the landing area ahead of him.

Goodbrake says he was unable to stop his momentum but made a despearte effort to avoid hitting the person standing in the water at the bottom of the slide. He says his evasive move caused him to break both his tibia and fibula.

Goodbrake accuses the park and its employees of negligence for allegedly telling him it was safe to slide when it was not. He is also suing the park's developer for what he contends is a negligent design of the slide.

Goodbrake is asking for more than $100,000 in damages for medical expenses and court costs.

Attorney Marc W. Parker of Maryville is representing him. They ask for a jury trial.
