Hylla dismisses Madison County woman's benzene suit

Madison County Circuit Judge David Hylla on Tuesday dismissed a four-year-old Madison County benzene case following a notice of dismissal filed by the plaintiff May 24.

Hylla ordered each party in the case to bear their own costs.

Plaintiff Paula Dangerfield had claimed a diagnosis of acute myelogenous leukemia Nov. 27, 2006, according the lawsuit filed Oct. 31, 2008.

Dangerfield originally sued 12 corporations, alleging a leukemia diagnosis after being exposed to benzene-containing products at her workplaces.

Dangerfield worked from 1992-1993 and from 1995-1997 at Afton and from April 2001- June 2006 at Reilly Industries, the suit states.

By working with and being exposed to the aforesaid benzene-containing products, plaintiff was cumulatively exposed to benzene, the suit stated.

The 12 corporations named in the suit failed to warn of the benzene's presence in their products and failed to warn of the harm associated with exposure to benzene, Dangerfield claims.

While Dangerfield worked at Afton, she labored close to spaces designated as "Benzene-Regulated Areas," but was not provided with adequate protection, she alleged.

She was represented by Thomas E. Schwartz of Holloran, White and Schwartz, St. Louis.

Defendant Drummond Company and Sloss Industries Corporation are represented by Jeffrey R. Glass and Mark D. Bauman.
