Anderson Hospital and doctor sued over surgery-related injury

A woman has filed suit against a doctor at Anderson Hospital, alleging she sustained a tear in her hip during a surgery.

Jayme Duncan alleges defendant Dr. James Dallariva performed a procedure at defendant Anderson Hospital on April 23 to repair Duncan's bladder dysfunction. However, following the procedure, Duncan was unable to move her left leg and experienced tremendous pain in her leg and pelvic region, according to the complaint filed April 23 in Madison County Circuit Court.

"Although the procedure was originally to be an outpatient procedure, Plaintiff's pain and inability to bear weight connected to her left leg required Plaintiff to remain hospitalized for six days," the suit states.

It took months for Duncan to realize what had happened. In September, doctors finally discovered the reason for Duncan's discomfort stemmed from the fact that she had suffered a left hip labral tear during the surgery, the complaint says.

Because of her tear, Duncan claims she suffered disability and disfigurement, lost wages and can no longer participate in certain activities.

In her two-count complaint, Duncan is seeking a judgment of more than $100,000, plus other relief the court deems just.
