Petsmart sued over man's slip on wet bathroom floor

Glisson

A Madison County Petsmart is accused of negligence after a customer says he slipped and fell on a wet bathroom floor.

Wayne Verhagen filed the lawsuit against Petsmart Inc. on April 12 in Madison County Circuit Court.

Verhagen says the injury happened while he was at Petsmart store in Madison County. The specific address of the store is not listed.

Verhagen says he was in a restroom walking toward the sink to wash his hands when he slipped on a wet spot and fell. Verhagen says the floor was wet because the sink drain was leaking, causing water to cover the floor and walkway.

Verhagen says he slipped and fell on the floor with "great force and violence" and hurt his ankle, back, tailbone and buttocks. He says he has and will continue to endure pain and suffering and mental anguish.

The man accuses Petsmart Inc. of negligence for allegedly not properly maintaining the restroom, failing to repair the drain, failing to provide a non-stick service on the bathroom floor and for failing to warn customers of the danger. Verhagen is asking to be awarded more than $50,000 for medical expenses, disability, lost wages and disfigurement.

Attorney Michael P. Glisson of Williamson, Webster, Falb and Glisson in Alton is representing Verhagen.
