Texas attorney to participate in Madison County benzene case

Madison County Circuit Judge Dennis Ruth on Friday allowed Texas attorney Jim C. Ezer admission to participate in a Madison County benzene case behalf of E.I. DuPont de Nemours and Company and First Chemical Co.

Ruth also ordered that James O'Brien of the St. Louis law firm of Lewis, Rice & Fingersh remain designated as local counsel.

Plaintiffs Ricky Marshall and Jerry Marshall by their attorneys at Saville & Flint on Friday requested the court to enter an order dismissing defendant Pharmacia Corporation, formerly known as Monsanto Company.

A motion to dismiss Monsanto from the case is pending.

The Marshalls sued more than 60 defendant companies. Marshall worked as a pipefitter from 1970-2008 when he was allegedly exposed to benzene and benzene-containing products, according to his complaint.

Because of his exposure, he developed acute myelogenous leukemia and was diagnosed with the cancer Sept. 5, 2011, his suit states.
