Lebanon Care Center sued over resident's fall injuries

Yandle

A man sustained head and face injuries after he fell at a nursing home, according to recently filed court documents.

Stephan A. Baldovski filed a lawsuit March 8 in St. Clair County Circuit Court against Petersen Health Network doing business as Lebanon Care Center.

In his complaint, Baldovski alleges he was living at Lebanon Care Center when he fell. Baldovski does not specify how the fall occurred, but does say that it could have been prevented had the nursing home provided siderails.

In addition to his injuries, Baldovski experienced pain, suffering, mental anguish and emotional distress and became further disabled and debilitated, according to the complaint. He also has experienced an impaired ability to enjoy life, the suit states.

Baldovski blames Lebanon Care Center for contributing to his injuries, saying it negligently failed to provide safe transfer actions, failed to protect his safety, failed to evaluate him to ensure that he received proper supervision, failed to protect him from neglect, failed to provide reasonable treatment and failed to meet his needs.

In his complaint, Baldovski seeks a judgment of more than $50,000, plus costs.

Staci M. Yandle and Tiffany R. Ellis of The Law Offices of Staci M. Yandle in O'Fallon will be representing him.

St. Clair County Circuit Court case number: 12-L-127.
