Woman sues ex-husband's employer for not timely turning over child support payments

A woman is suing her ex-husband's Caseyville employer for allegedly not turning over his child support payments in a timely manner.

Veronica M. Mayes filed a lawsuit against Black Lane Auto Parts Inc. on Feb. 21 in St. Clair County Circuit Court.

Court records show Mayes, formerly known as Veronica Ethington, and Calvin Christopher Ethington entered into a divorce decree in Jackson County Circuit Court. Mayes says she was granted a court order calling for Ethington's employer to withhold $140 per week and remit that amount to the Illinois State Disbursement Unit within seven business days.

Mayes claims income withholding notices were first sent to Black Lane Auto Parts in March 2010 requiring the $140 to be withheld beginning with Ethington's next paycheck. The company allegedly signed a certified letter containing the order to withhold. However, Mayes alleges that on more than one occasion Black Lane Auto Parts took more than seven days to forward the child support payments to the State as required.

Mayes contends the Caseyville company is liable for a penalty of $100 per day for every day past seven business days that the payment was not remitted. She asks the court for a judgement of more than $75,000 in penalties plus the cost of the lawsuit.
