Leasing company sues over auto repairs

A leasing company has filed suit against the owners of vehicles it leases, saying the owners refuse to pay for repairs to the automobiles.

Bush Truck Leasing claims it has lost $68,153.41 when defendant Delivery Logistics failed to abide by an agreement.

Under an agreement, Delivery Logistics agreed to endorse Bush's maintenance program or to require independent contractors to receive permission from Bush for alternative maintenance care, according to the complaint filed Feb. 24 in Madison County Circuit Court.

However, Delivery Logistics failed to honor its agreement, the suit states.

"Defendant withheld from each Independent Contractor on a monthly basis certain monies representing the amounts due by each Independent Contractor to plaintiff, which monies defendant was required by the program agreement to remit to plaintiff," the complaint says.

As a result, Bush claims it lost the $68,153.41, plus an additional $107,835.85.

In addition to the money it says it is due, Bush is seeking interest, costs, attorneys' fees and other relief the court deems just.
